Chief Justice Roberts...Genius, or Fool, or both?

Just wondering...is Chief Justice John Roberts a genius, a fool, or perhaps a bit of both? Mitt Romney says he disagrees with the Chief Justice's siding with all the liberals on the court. Every conservative on the court plus the usual swing vote, Justice Kennedy, said that the Chief Justice's vote was nothing more than the SCOTUS (Supreme Court of the The United States) making law through Judicial Activism, which is clearly unconstitutional. Other conservative commentators that I have heard are all over the map, some saying that Justice Roberts was wrong (Rand Paul, Alan West), others saying that he awakened a sleeping giant (Dick Morris), others brand it the death of America's freedoms (Limbaugh, Hannity, Laura Ingraham. Who is right?
Much remains to be seen here. But, like every other major decision from SCOTUS, there certainly is no lack of opinions, pontifications, and forecasts of gloom and doom or utopia, depending on one's political philosophy.
Here is an excellent website saying that Justice Roberts made the right decision, in an op-ed by Bert Atkinson, Jr. http://www.ijreview.com/2012/06/9398-why-chief-justice-roberts-made-the-right-long-term-decision-with-obamacare/ . Here is another article where numerous conservative commentators universally condemn the decision as an assault on freedom: http://www.wnd.com/2012/06/rush-freedom-just-met-its-death-panel/ .
What is the outcome? In all actuality, no-one really knows. One thing is for certain, however, is that America will never be the same again. The Supreme Court has, by abdication, become the most powerful branch of the Federal Government. It can, by judicial edict, make national law, as is seen in this latest decision (a power Constitutionally given only to the legislative branch of the Federal Government), or it can destroy law by declaring it unconstitutional, or even rewrite the Constitution by re-interpreting previous decisions, ignoring precedent making decisions from the past, and ignoring the original intent of the founding fathers as they wrote the case decisions of the past based upon the intent of the writer of the section of the Constitution or the case law decision being revised.
This was NOT what the founding fathers intended; in fact it is the exact opposite of what the founding fathers intended. Thomas Jefferson, who I believe was probably the smartest of our founding fathers, warned us of the implications of allowing the Supreme Court to dominate the three branches of the Federal Government when he said the following:

The germ of dissolution of our federal government is in the constitution of the federal judiciary; an irresponsible body, (for impeachment is scarcely a scare-crow) working like gravity by night and by day, gaining a little today and a little tomorrow, and advancing its noiseless step like a thief, over the field of jurisdiction, until all shall be usurped from the States, and the government of all be consolidated into one.
Thomas Jefferson, letter to Charles Hammond, Aug 18, 1821

We are seeing Jefferson's words come to pass as we live and breath today. With lifetime appointments, with really no firing mechanism in place but impeachment, which has never been utilized in the two-hundred forty years of the republic thus-far, these nine political appointees sit immune to any repercussions from their decisions.
This last decision, for instance, is replete with wrong-doing. Justice Elana Kagen, an Obama appointee, should never have been in on the Obamacare decision. A former Solicitor General under President Obama, she was obviously involved in the furthering of this bill, and correspondence shows that she was following its progress with anticipation of it becoming law. Yet, with her nomination by President Obama to the Supreme Court, it presents a clear case of “stacking the deck” with Justices that have a vested interest in the upholding of a law that she was part of the formulation of as Solicitor General to the President whose bill it is. This is a Supreme Court Justice that is so blatantly socialist/liberal in her political philosophy and so obviously had a vested interest in upholding the Constitutionality of Obamacare that she should have recused herself from this case. I cannot recall any situation in history where behavior like this has been tolerated. You have a Justice of the Supreme Court that undoubtedly was part of the formulation of a bill that the President of the United States that nominated her for the Supreme Court got passed through a loaded legislature, was overturned as unconstitutional by numerous Federal Courts in the land, upheld by the most liberal Federal Court in the land, went to the Supreme Court that she is now a part of, and she deems herself to be able to render an unbiased opinion on the law. Surely we must all be fools because we let her get away with that and did not even breath the evil “I” word (Impeachment!). That is one vote FOR this travesty to every U.S. Citizen that should NEVER have been cast, and would have spared us this interminable nightmare.
There was never any doubt about the way our Liberal/Socialist members of the court would vote. Justices Breyer, Ginsberg, Sotomayor, and Kagen were givens...they will vote for whatever a liberal President or Congress wishes. Likewise, there are three conservative justices that will always vote according to the Original Intent of the founding fathers as they penned the Constitution and its Amendments, e.g., Justices Alito, Thomas, and Scalia. Usually, Justice Roberts has voted with the conservative members of the Court, and Justice Kennedy has been the swing vote, who in this instance voted with the conservatives. But Justice Roberts, in this instance, was the maverick on the Court and voted in a way, and with reasoning that no-one in their wildest dreams could have envisioned.
Chief Justice Roberts voted with the liberal wing of the Court this time and allowed Obamacare to stand as a Constitutional law, but did NOT do it in the way that was envisioned. The entire debate on whether or not this law was Constitutional or not has revolved around the Administration's claim that under the Interstate Commerce Clause (Article 1, Section 8, Clause 3), they could impose a penalty fee onto anyone who would refuse to purchase insurance under Obamacare. As went the mandate, so went the entire law under the commerce clause, or at least so everyone in the nation except Chief Justice Roberts thought. Every Democrat in the House and Senate and the President of the United States swore up and down this penalty was not a tax increase, but that is exactly what Chief Justice Roberts called it, and therefore, because the Legislative Branch does have the power to levy taxes onto the citizenry of the U.S.A., this law is Constitutional. But Chief Justice Roberts was not through; he went on to say that the Administration's claim that they could use the Commerce Clause and force Americans to buy a product was NOT Constitutional; and he went further saying that the leverage that the Federal Government wanted to use via withholding ALL Medicaid funds (as opposed to the additional Medicaid funds associated with Obamacare) to States that did not implement Obamacare was not Constitutional. This was part of the lawsuit that twenty-eight states plus numerous universities and and other governmental bodies had filed against Obamacare.
Already, several States, including Louisiana, have made statements that they will not implement Obamacare, and basically there is nothing that the Federal Government can do about it. Many of the political commentators are saying that not only are many people just going to refuse to buy the insurance, but they are going to refuse to pay the penalty/fine/tax, or whatever that charge will be, and the commentators are saying that there really is nothing that the IRS can do about it. So...where does that leave us with our original question; e.g., is Chief Justice Roberts a genius, or a fool, or a little of both?
My personal opinion is that he is perhaps a little too smart for his own good and for the good of the nation. In my opinion, based on the Chief Justice's previous opinions and on his personal stated views during his confirmation hearings, it is my belief that the Chief Justice took a calculated gamble with the future of America. It is my belief that Chief Justice Roberts is determined to drive the Court back into the direction of a strict Original Intent representative view in its decisions. I believe he is a very conservative Justice and is trying to set an example of following the letter of the Constitution regardless of whether the decision is liberal or conservative in its outcome.
In this case, I believe he is sincere in believing that the “penalty”, or “fee” that the liberals have assigned to those refusing to purchase the individually mandated insurance under Obamacare is, in reality a tax, very similar to the Social Security tax, and therefore legal. I also believe that he declared it as such in order to re-ignite the conservative movement's backlash against any new taxes and in doing so, hopefully drive the election in November deeply into the Republican's hands, ultimately giving them a super-majority in both houses, which will inevitably lead to a total repeal of this monstrosity called Obamacare.
I also believe that this is a VERY dangerous gamble with the future of America's healthcare industry, and with the future of our economy in general. I am convinced that the Chief Justice is sincere in his beliefs/hopes that he has pushed conservatives over the edge and, as Dick Morris suggests, “awaken a sleeping giant, and instilled a terrible resolve into him” which will return America back to the nation that our founders envisioned. My only fear is what may happen if the gamble does not work.
Many American, me being one of them, are sick and tired of a tyrannical, nanny-state government using my hard earned money paid in as taxes to buy votes from deadbeats and illegal immigrants and their families. I am tired of paying people to sit at home on their butts and do nothing but have bastard children so that they can receive a handout from Uncle Sam for each child that results in them making twice as much as I make in retirement and social security combined! I had to work for forty years, and some woman can sit on her butt, pop out children like a baby factory, and collect TANF, Welfare, food stamps, and receive a free cell phone, free transportation, free child care, and free or subscidized housing, while I worked for forty years to provide for my family, and I have to pay for everything, including the deadbeat's free everything. That is not what our founding fathers envisioned, and is NOT the American way.
Our Declaration of Independence states that we are endowed by our Creator with certain unalienable rights, including Life, Liberty, and the PURSUIT of happiness. It does not guarantee us happiness, it does not guarantee us a free cell phone, free food, free or subsidized housing, free transportation, or free anything. Even the Bible, which the founders of our nation said was the “...cornerstone of the republic...” states in Thessalonians 3:10-12: "If anyone is not willing to work, let him not eat. For we hear that some among you walk in idleness, not busy at work but busybodies. Now such persons we command and encourage in the Lord Jesus Christ to do their own work quietly and to earn their own living."
I believe that America needs to phase out of the Nanny State mentality as quickly as possible. That philosophy has been tried throughout history and has never worked. It cannot work, because only in an all-Christian world could such a society every exist, and as we all know, that has never been, and will never be until the second coming of Christ, then the tribulation, and lastly the final judgement. Until then, we are going to have to function in a world filled with evil, and be ever vigilant against it. We are a nation built on freedom of religion, not freedom from religion. We are a nation built on a Constitution which was written to restrict the Federal Government's intrusion into the lives of its citizens, and which delineates the powers given to the Federal Government and strictly says which freedoms that Federal Government cannot invade. But, as Jefferson described so long ago, over time, a step at a time, the Court has slowly began usurping the powers away from the Executive and Legislative branches so that now, simply by declaring a law or a freedom as unconstitutional, they have neutered the Legislative Branch's ability to protect our freedoms, and through Judicial Activism, have stripped the States of most of their sovereign rights as guaranteed under the Constitution.
Justice Roberts, in my opinion, made a grave mistake with his decision. He is gambling that America's conservatives will rise up in revolt at the ballot box in November and will oust a vast majority of the liberals in Congress and the White House because of the overwhelming majority of them that hate Obamacare. However, he has taken a grave risk, because there is a large number of special interest groups that will virtually block vote for Him and liberals, regardless of anything that the conservatives do, because they are more concerned with protecting their government entitlements than they are destroying the nation's economy and freedoms. They are willing to sacrifice their self-esteem, their freedoms, and the nation's future in order to preserve their free ride, even if it bankrupts the nation, which it is inevitably guaranteed to do. I would much rather Chief Justice Roberts simply ruled that the Commerce Clause did NOT permit the individual mandate, not sought out an avenue by which he could keep the law Constitutional, but have just taken the Democrats at their word that the mandate was not a tax, and voted with the conservatives and ruled the law un-Constitutional. Instead, he may have awakened the sleeping giant, but instead just long enough for him to roll over and be lulled back to sleep nursing at the breast of the Un-United Nanny State of America.

OBAMACARE'S FINAL INSULT: A WOMAN'S SUFFERING IS WORTH $45 - $70 PER MONTH!

Shown below is the text I have sent to my U.S. Senator regarding my appeals to TRICARE/EXPRESS scripts to have them provide a name brand medication to my wife instead of a "generic equivalent". The details of all of this have been amply provided in previous blogs, as shown in the links below:

http://thepatrioticsoldiersblog.blogspot.com/2012/03/obamacare-example-of-what-we-can-expect.html

http://thepatrioticsoldiersblog.blogspot.com/2012/03/update-on-preview-of-obamacare.html

http://thepatrioticsoldiersblog.blogspot.com/2012/05/obamacare-curse-strikes-again.html

We received the results of our final appeal option yesterday. I have posted this text of a letter to my Senator in which I have quoted the decision of the appeal. I have blacked out the names of the medications involved, her symptoms, and the name of my wife's doctor to provide some privacy for my wife. But the decision and my reaction to it are obvious. Make your own decisons from here, but from my perspective, the future for America's healthcare as would be dictated by the government, and believe me that is where we are heading under Obamacare, is disastrous. If you doubt me, just examine the type of treatment received when you go into the Social Security office for help, the U.S. Post Office, or talk to anyone under Medicare or Medicaid and see what type of treatment they receive compared to what individuals receive under private healthcare options. The government's treatment is nothing short of inhumane and barbaric.

Dear Senator Vitter:

I have kept you advised regarding our appeals to TRICARE/EXPRESS SCRIPTS to have my wife's prescription for the name brand medicationYAZ reinstated. As you know, we have made three written appeals to have the prescription reinstated. We just received the most recent one, a denial, from the outside agency which is the final appeal available under TRICARE/EXPRESS SCRIPTS's policies. Again, the appeal was denied. I am enclosing below the text of the letter regarding the decision:

TQMC DECISION

In response to your request for a reconsideration of the initial denial determination made regarding the above-referenced service, this case was presented to a board certified independent physician reviewer.

After conducting a thorough re-examination of all the information contained in your medical record and consideration of any additional information submitted, the physician reviewer has upheld the denial.

There was no information about which generic substitutes were tried by the patient nor the duration that each was used. There were no specific details provided about the generic equivalents failure to control cramps and abnormal bleeding.

This is very unusual because the Food and Drug Administration (FDA) and American College of Obstetricians and Gynecologists (ACOG) clearly state that generic equivalent drugs produce the same clinical results and safety profiles and are interchangeable for therapeutic benefit (1,2). There is no detailed evidence in the records reviewed to challenge this conclusion.

It is also unclear as to what generic drugs the patient used and how long she tried each one. It would be reasonable for the patient to try all the Yaz generic equivalents, such as Vestura, Loryna, or Gianvi, whichever she has not used yet and to do so for at least three (3) months in order to determine if it is effective.

I find it abhorrent that a medical physician who supposedly reviewed all the information provided by us and by Dr. Pennebaker would make such a statement. And please keep in mind that we are talking about appealing a decision on a prescription that will cost approximately $40 to $65 more per month than the generic brand product that TRICARE/EXPRESS SCRIPTS wants to force my wife to take.

As I read this letter, the United States Government's policy, as enforced on its veterans and their families, thinks it appropriate that one of its citizens be forced to try as many as three different medications for a period of up to three months with the possibility that the citizen could suffer severe bleeding and cramps that she already has experienced when forced to try a different generic drug a year earlier, when there is a product that the citizen has already tried which it is known causes no suffering side effects.

Is there any other conclusion than that which states the United States Government is willing to take a chance and inflict up to nine months of suffering onto one of its citizens in order to save $70 per month when it throws more than that away on a variety of worthless give-away plans to citizens who pay no taxes and have never served a day in their lives in the service of this country? It is improper for me so show absolute disgust that my government will allow the President of the United States to waste millions of dollars politicking by flying around the country at $8 million per hour in Air Force One, but cannot justify paying even as much as $70 a month for a prescription which it know absolutely to cause no side effects to the wife of a man who spent twenty years and fought in two foreign conflicts?

What happened to the primary oath that all physicians follow of “First, do no harm.”? It appears to me that this covenant has been overshadowed by the Government's covenant of “damn the patient, save a dollar”.

Needless to say, I am disgusted and disappointed and depressed. Disgusted at the priorities that my government has established with regard to the medical treatment of its veterans and their families as is shown in my and my wife's case. Disappointed that in a country like the United States of America, the Federal Government could institute a policy or even make a statement that would suggest it would think it appropriate to force medications on a woman for up to nine months that could cause her to suffer with excessive bleeding and cramping when there is a medication proven by the patient's usage for years available that has no risk of side effects. That is just barbaric.

I am depressed to think that this is the type of care and the type of conflict that I can expect for the rest of my and my wife's lifetime. I served my country for twenty years. I would think that I have earned for my wife and my family at least humane treatment when I or my wife are sick. But all I am receiving is treatment that tells me the Government is willing to accept my wife or I suffering pain and discomfort for up to nine months in order that the government can save from $40 to $70 per month.

When I joined the military in 1969, I was promised, if I served twenty years, free medical care for me and my family and a pension for life. That promise was broken years ago. Now, I cannot even expect humane treatment for me and my wife, even with me paying for the coverage.

Let me ask you, Senator? Would you allow this type of treatment for your wife or your children? Would you stand by and watch your wife double over in pain and suffer sever bleeding and do nothing? Would you force her to try different medications that could cause her pain and suffering for up to nine months when there is drug she had been taking for YEARS before which was now being denied her that did not cause any side effects?

Sincerely,

WHY COMMUNISM OR SOCIALISM CAN NEVER WORK!!

Socialism/communism are utopian forms of existence/government. In their conceptual philosophy, they are very attractive. They propose an existence where everything is owned and controlled and distributed by the “State”. An oversimplification of its overriding theme is “share and share alike”. And while that is an exceptional and admirable existence dream, here on earth, that dream has no possibility of ever existing successfully. Why not, some may ask? Because it simply defies human nature, ignoring the drastic world views held by different nations around the world.
For socialism/communism to work, there are four assumptions that must be assumed true:
  1. Mankind is basically good by nature
  2. Every person would be satisfied with whatever they are given, and would not aspire to “...more.”
  3. The “State” will always do what is “right” for the people.
  4. The “State” will be allowed to exist without interference from other countries/states as long as it does not interfere with those other countries' internal or external operations.
Let us look at each of these assumptions in more depth. First, we must examine mankind's basic human nature; e.g., is it basically good, or bad by nature? We can get very deep into the debate on this subject, but at its very basic nature, to determine whether or not our nature is good or evil, we can simply look at very young children. By their nature, virtually all children come into this world selfish. Left alone, children do not like to share, will, by nature, set up a hierarchy among their social and even family structures that determines who the dominant member of the group is, and will resists changes that go against those character traits or hierarchy.
For those that are of the Judeo-Christian faith, there is also biblical scripture that indicates this assertion. Romans 3:23 (NKJV) says “for all have sinned and fall short of the glory of God,” John 9:34 says “They answered him, 'You were born entirely in sins, and are you teaching us?' So they put him out.“
Countless experiments have been done proving that we come into this world with a sinful nature, and only by correction and the enforcement by others of God's an/or man's laws do be become able to co-exist with other humans in a civilized way. Even those who proclaim themselves as Christians acknowledge that every day we sin, and only through redemption received through confession and repentance of our sins can we re-establish our covenant and personal relationship with the Father.
The second assumption, e.g., every person would be satisfied with whatever they are given and would not aspire for “more”, has been proven to be totally unsustainable and unworkable through the human experiment for centuries. For recent examples, look at the Soviet Union, Cuba, Romania, Czechoslovakia, Germany, even today places like Greece, Italy, France, North Korea, Iraq, Libya, Syria, places where the “State” has supposedly tried to take care of its peoples and control them, but they have exploded in revolt or have regressed in the condition of their people overall because of the human nature's resistance to domination, to having their freedoms restricted, and to having been taken over by cruel, oppressive dictators or regimes. It just does not work.
The failure comes because in most free societies, the State itself has no means to generate revenues other than through taxation, fees, tariffs, and /or conquests. Since the world went to basically a system of paper money, a medium of exchange with no real value except that which is established and guaranteed by the governments themselves, government's ability to buy goods and services from other countries depends upon the world's valuation of its currency. Whether the country directly owns the products and goods sold to internal and external markets, or whether it taxes the individuals living in the country to raise the capital needed to operate, in general, the world operates based on paper, and even non-existent paper or coins through electronic transactions for the exchange of goods and services between countries. This which means that no longer is a government's ability to operate entirely dependent upon goods and services provided from internal means; all governments must now operate in a global economy where opinion, and the reliability and productivity of its citizens helps to determine the valuation of its currency, and therefore its ability to buy goods and services from other countries..
The evolution of electronic communications systems (telephone, computers, wireless communications, access to the World Wide Web and the Internet have made it virtually impossible for repressive regimes to restrict their citizen's awareness of the economic conditions in other nations. This awareness of economic and social conditions around the world has vastly increased mankind's unrest with their own state of affairs, especially in the underprivileged nations of the world. Demand is increasing world-wide for “more”; more goods, more freedoms, more money, more of everything that those in underprivileged areas see those in more privileged areas enjoying.
Mankind, by nature, wants freedom. They resist either overtly or covertly any force that tries to take that freedom away or restrict it by oppression. We see that resistance to having our freedoms restricted throughout every species of living creature on the earth. Try to cage any animal and see the resistance that is put up. Take any animal that has been living in a cage even since birth, and take it out of that cage, eventually, it will leave to never return unless stopped. Even plants want to grow and expand. Restrict a plant's space in which to grow, and eventually it will wither and die. Allow a plant unlimited access to growth and it will continue to grow until its limbs can no longer support that growth. That is a law of nature. Nothing, nor no one want to be constrained. Freedom and growth are instinctual goals for every living thing.
The disproving of assumption number one is also the proof that Assumption number three will always be proven false. The “State” is nothing more than a structure of constraints and guidelines by which those under its coverage receive their boundaries of behavior. Depending upon its structure, those guidelines and constraints are determined by individuals comprising the “State”, either through elected and/or appointed officials or by a supreme ruler who then imposes his/her will on the people through force, with, of course, innumerable variations that include some of both.
History is again our best teacher here of the fallacy of believing the State will always do the “right” thing for its people. Since recorded history began, mankind has seen innumerable examples of governments being established by dictators and monarchs which have, over time, been overthrown or conquered by force, both internal force and external force. Likewise there have been numerous cases where democracies and republics have been established, and, over time, decayed through weakness or internal corruption to the point that they have been removed/replaced through internal or external force. Thomas Jefferson, America's third President, stated his beliefs about government's ability to do the “right” thing all the time for its citizens, when he said these famous quotes:
  1. “The strongest reason for the people to retain the right to keep and bear arms is, as a last resort, to protect themselves against tyranny in government. “
  2. When the people fear their government, there is tyranny; when the government fears the people, there is liberty.
  3. What country can preserve its liberties if its rulers are not warned from time to time that their people preserve the spirit of resistance?
  4. Most bad government has grown out of too much government.
  5. A little rebellion now and then is a good thing and as necessary in the political world as storms in the physical.
  6. “Government big enough to supply everything you need is big enough to take everything you have. The course of history shows us that as a government grows, liberty decreases.”
Jefferson knew from his experiences dealing with foreign governments that the older established governments of Europe were all basically corrupt and self-serving, caring little for the people they governed. History shows us time and time again that as individuals get a taste of power and privilege at the expense of those they govern, with very few exceptions, their lust for more of that turns even the most honest and caring individuals into self-serving, greedy individuals with little concern for their constituants. Even in our nation's young life, we can see the fallacy of this type of argument that the States will always do what is best for those it governs. We have seen and had recorded in minute detail the rise and fall of virtually every type of governmental structure known to man. Germany and Japan rose through military power as the AXIS powers with the intent of destroying and/or dominating every other form of government on the earth. Why, because internally they did not have all the materials/resources they needed to exist at the level they wished and to install their idea of the “State” as they envisioned it, so they had to take from others in order to create and sustain their vision of a utopia on earth. The same with Communism/Socialism throughout the world, especially evident in the Soviet Union and its efforts to establish a world-wide Communist Utopia. It, too, failed because of its evolution into one of the world's most oppressive and cruel empires.
Even here in the United States, we are seeing the degradation of our freedoms through the growth of government controls and regulations. Whether well-intentioned, or diabolical in nature, America's elected officials have continually regulated and legislated away the rights of the majority of its citizens in an effort to create a totally equal society, where no-one will have any kind of privilege or advantage over another. That society can never exist, because there will always be individuals that want “more”, and when they cannot get “more” by conventional means, will either try to force government to give it to them, or will try to take it away from those with more by whatever means they can. Well intentioned or devious individuals in positions of government with the ability to socially engineer change have, over the last sixty years, tried numerous attempts to govern people out of poverty with a dismal record of failure. Again, a failed approach that has been tired over and over and, in the past, has failed every time. Laws have been passed which supposedly prevent any type of discrimination by one person or one company against another, but the realities are that for every law that is passed, unscrupulous people will find a way to circumvent or hide their violations of that law. The only way mankind has ever raised its economic, social, and political status has been to work for it, and to have government basically get out of mankind's way.
Regulations implemented to supposedly prevent as much opportunity for man to injure his fellow man have made it virtually impossible for someone to start a new business today because of the costs of complying with these needless regulations. Government officials have continued to expand their ideas of the government's responsibilities to take care of its citizens, which has in turn, driven up the costs of government to a point where the government cannot sustain its give-away programs without excessive taxation or borrowing, and because people who realize they can vote themselves something for nothing, will elect individuals who promise them that something for nothing. Whether they realize there really is nothing “free”, that somebody will pay for it somehow, does not seem to matter. It is a fallback to that “looking out for #1” mentality that exposes the underbelly of man's selfish, evil nature.
The Fourth Assumption has never been proven true in all of recorded history. Stronger nations inevitably have reached out and taken resources from weaker nations throughout recorded history. It is said that when Alexander the Great finally conquered all of the known world at his time, he sat down and wept because there was nothing or no one else left to conquer. America, in its short history, has proven to be the only nation in history to disavow the goals of conquering other nations by force to expand its availability of resources needed to sustain its economic and social growth. No other nation has ever conquered so many nations in battle where it was attacked from outside forces, then after vanquishing those nations in battle, turned around and expended its own resources to re-establish those vanquished nations as independent, free economic, social, and politically free entities. But that government has grown more and more oppressive and has degraded so drastically from a moral and spiritual perspective in the last sixty years, that it, too, has begun to resemble those evil empires that we so recently have fought to overthrow.
In summary, until not only America, but the entire world realizes that history assures the continual appearance of evil and/or corrupt individuals and governments because of the sinful, evil nature of mankind, the social, economic, and political dreams of some type of utopian socialist or communist type of government will continue to rise and, eventually, be destroyed. Not until mankind can rid itself of its sinful, evil nature completely, could socialism or communism work, and since history has proven that likelihood virtually unthinkable, the probability of a utopia existing on this earth is absolutely zero until the second coming of Christ and the casting of all evil spirits into hell for eternity occurs.
Until then, the struggle against oppressive governments will continue, and until people realize that no government should ever be trusted to provide for the needs and freedoms of its people, the dreams of that utopia will continue to be contemplated upon, and tried, and proven unworkable time and time again.
“The definition of insanity is the belief that by doing the same thing over and over again, one can expect a different outcome to occur”.

The ObamaCare Curse Strikes Again!!!

Well, the ObamaCare bureaucrats/terrorists have struck again! To catch everyone up, starting back in March, we started fighting with them when some internal policy change at EXPRESS SCRIPTS, the TRICARE pharmacy contractor, caused them to reverse a decision from less than a year before that which provided my wife a name brand medication when she had a severe reaction to a generic they forced us to try (read about it in these older blog posts if interested:
We were forced to file a “final” appeal to an outside agency (KePRO) when they turned down the second appeal we filed to EXPRESS SCRIPTS. This time, my wife's physician wrote almost a full page detailing the difficulties that my wife had when she tried the generic, and explained that she was obviously the exception to their claims that the generics were medically equivalent to the name brand.
Well, we were just informed that this appeal was denied as well, and this is the last appeal we can file. The next step is a lawsuit, but I cannot find a lawyer that will file for me because they will not take a case on contingency against the Feds. So...the retired military veteran gets screwed again by the big Federal Government. Those SOBs sit up there, most of them would not know one end of a rifle from the other and have never been in harm's way, they enjoy their gold-plated medical plans and exclude themselves from these crappy plans they force on those that have laid their lives on the line to protect their rights to screw us and pad their own pockets. This is just WRONG!!!
What is even more infuriating, both times my wife's appeals were turned town, I asked to speak to the physician or person who made the final decision, but I was told that was not possible; that they do not allow that. So, what we have in place now at the Federal Healthcare system level are nameless, faceless bureaucrats making decisions about citizen's healthcare that, when questioned or challenged, hide themselves behind their corporate structures and provide the recipients a form letter spouting the corporate lines of garbage, while they ignore the facts.
My fellow citizens, we hear about the nightmares coming with ObamaCare; well they are already here. And they are being shoved down the throats of America's veterans and their families, where they literally do not care about negative consequences which have already surfaced when their decisions were tried, they just say try a different manufacturer of another generic so that we can save $40 bucks a month on a prescription, but possible inflict more suffering and medical problems on the guinea pig patient. Plain and simple: Bureaucrats are already making decisions to the detriment of citizen's medical well being, and their decisions are absolutely opposite to medical evidence from the patient's own local physician(s). It has taken nearly four months to fight the battle thus far.
I have a closing question for you. Had you seen your wife suffering because of a medication, how would you feel being told that her suffering was not back enough or serious enough to justify giving her a medication that she had been taking for years with no side effects, and instead being told that she had to try another, different generic drug and risk more suffering and negative side effects because it costs less than the name brand? If you think this is an acceptable way to have yourself or your loved ones treated, then you need to do nothing. But if you, like me, think this is absolutely unacceptable treatment, then I hope you will call your congressman and senators and tell them of your outrage! That is exactly what I intend to do.

ILLEGAL IMMIGRANTS DEFRAUDING THE US TAXPAYER OF BILLIONS!

I wonder how many Americans don't realize that the Federal Government is literally giving away BILLIONS of U.S. Taxpayer dollars to illegal immigrants in one of the largest cases of tax fraud ever perpetrated on Taxpayers and it is done THROUGH THE IRS!!!
Here is how it works and how STUPID our Government bureaucrats and lawmakers are.  The IRS requires everyone that earns money in the United States, whether they are here legal or illegally, to file a tax return.  Since illegal workers have no social security number, the IRS has established something called an INDIVIDUAL TAXPAYER IDENTIFICATION NUMBER (ITIN), that illegal immigrants are getting to file these tax returns.  (OK...let's see if this is clear; I cannot get a social security number from the social security department, but I CAN get a ITIN from the IRS and file a tax return?)
Here is where the situation gets really "stinky".  The IRS has a "loophole" where I, as an illegal immigrant, if I file a Federal Tax Return, can claim I am supporting virtually an unlimited number of children through something called the "Additional Child Tax Credit", and that child does not even have to be mine.  I can list my nephews and or nieces, or a minor sibling, any minor child.  These illegal workers are frequently listing ten to twenty children, many or all of them LIVING BACK IN MEXICO as their dependents, and the IRS, the big "NANNY" to illegal immigrants and those who pay no taxes or do not work at all, just shovels the hard-earned tax dollars to them by the BILLIONS!
What is so disturbing to me out of this whole deal is that the IRS is just shoveling our dollars out the door to people working here illegally, and doing absolutely nothing about it, and yet they will crucify a legitimate taxpayer with huge penalties and interest charges if they are a day late, or make a mistake on their returns when filed.  The hypocrisy is HUGE!  Plain and simple, it is the mentality of those trying to buy the votes of the latino community that are here legally by pandering and handing out cash to those of the same ethnic group that are here illegally!
Our Federal Government's lawmakers and the liberal press with their "political correctness" mindset are afraid to do anything to alienate any minority fringe vote for fear of losing that fringe group's votes.  Plain and simple; do not do anything to alienate the homosexuals, illegal immigrants, African Americans, Latinos, Unions, environmentalists...just about any other fringe group you can think of, or I might lose their vote.  Well, their spineless fear of offending somebody is costing the U.S. Taxpayer billions of dollars, and sending much of it south of the Border, down Mexico way.  Check out this video that NEWSMAX magazine highlighted on their online magazine a couple of weeks ago, where this was exposed.

Why Can't We ALL Get Beyond Voting or Not Voting for Someone Based on Race?

There is a lot of news recently surrounding the “coming out” of President Obama when he stated that he was changing his prior position of being against Gay Marriage, and now supports Gay Marriage.
Much of the debate in the news, however, has swung away from the homosexuality debate and seems to now be focusing in on whether the flip-flop of the President is going to hurt him in the election.  Initially, the feeling was that it would, because there are many, many devoutly Christian African Americans that do not believe in Gay Marriage, and the thought/talk among many of the political commentators/analysts was that his announcement might cause them to change from their support of the President and vote Republican.
In just over a week since the President announced his new position, however, the political commentators are saying that it really is not going to hurt him very much.  Two African American preachers interviewed earlier this week on the FOX News Channel both said they were still going to vote for President Obama, but one of those preachers, just a few nights before this interview, had said he was going to not vote at all because of the President’s position.  When Bill O’Reilly asked him why the change, he said that he had received many calls from the members of his congregation about that, and now he was going to vote for the President after all.  Mr. O’Reilly pressed him on why the change of heart; why, when he was anti-abortion and anti-gay marriage, would he not vote for Mitt Romney, he said that he would never vote for Mitt Romney because Mr. Obama had better policies on the economy, on foreign policy, etc.   The man was so embarrassed that he could not even look into the camera.  The fact that he was saying what his congregation told him to say was so evident from his body language and his gestures and the inflections in his voice, I actually felt sorry for him.
The African American Community voted virtually unanimously in the last election for President Obama; ninety-seven percent of the black community voted for Mr. Obama.  It was a given then that they would, and frankly, it is probably a given in 2012 that the same result will occur, and that greatly disappoints me.
I am a southern, white, sixty-five year old male.  I listen to FOX on occasion, I’ll listen to CNN, NBC’s Today Show, and sometimes, just for grins, I’ll listen to MSNBC to see what the far left liberals are putting out.  The liberals are taking every opportunity to say that anyone that is against President Obama is a racist; that we only want him removed from office because he has African American blood in his veins, and frankly, I find that highly insulting.  To me, that is what liberals have to fall back on when they cannot win an argument against those who are going to vote against the President for any other reason.
For generations, blacks were assumed to be too dumb to be a part of white society.  Fortunately, over the last century, and especially in the last sixty years or so, America has wised up and realized that every human being has worth and should be measured by, to quote Dr. King, the “…content of their character and not the color of their skin.”  Too bad that so many of the black community have forgotten that part of Dr. King’s philosophy.  They are practicing the same thing that white Americans did for generations.  If the truth be told, they are going to vote for Barack Obama again because he is black, and because to do otherwise would incur the wrath of many of their fellow African Americans.
Am I saying that there are not those in the black community that did not and will vote for Mr. Obama for other than the fact that he is black?  No, I am not.  What I am saying is that when the percentages his ninety-seven percent, only an idiot would say that there is not a large number of blacks that are voting for President Obama strictly on race.
It can also be said that there are many in the white community that are voting for President Obama strictly because he is black, and they wish to prove that white Americans are NOT racist.
I wonder how the white community now would be described if they exhibited the same mentality as the black community is exhibiting, e.g., a blind determination to vote for the white candidate just because he is white?  Just like many in the African American community, there would be those that found some other reason to give that they were voting for him, but unlike the FOX News analysts, they would be called liars by the liberal press before the words got out of their mouths good.  How many news agencies would be on the air screaming racism, prejudice, bigotry every time that a poll came out and the results showed the white citizens of America block voting for a white candidate at the ninety-seven percent level?  That would dominate the headlines and commentators shows for months on end, expecially the ABC, NBC, CBS,  and CNN networks!  Jessee Jackson and Al Sharpton would be most prominent faces on television, except maybe with the exception of Joe Biden going nuts every time somebody asked him about it!  I just cannot stomach the hypocrisy that is being show in the media and the black community today with regard to their practicing racial voting on one hand, but condemning anyone who says they will NOT vote for Obama because he is black!
Maybe I'm old fashioned, but to me, wrong is wrong and right is right.  Morality, sin, good, evil....all those character traits are colorblind.  Just as it is wrong for white people to vote for a candidate just because that candidate is white, it is just as wrong for a black person, or a latino, asian, oriental, Arab, Jew, native American...really anybody to vote for a candidate just because of that person's ethnicity.
I will come right out and tell anyone that I would not vote for Barack Obama, but it has nothing to do with his race.  He has demonstrated to me a fanatical determination to push the far left liberal agenda down the throats of every American whether the majority want it or not.  I will not vote for him because he seems oblivious to the disastrous nature of driving up the national debt to the levels of bankrupting the country.  I will not vote for Barack Obama because he has insulted our traditional allies, snubs the traditional National Day of Prayer cereminies,  but participated in a national Islamic day of prayer, yet tells the world that America is no longer a Christian nation.  I will not vote for Barack Obama because he has broken every promise he made when he was a candidate.  I will not vote for Barack Obama because his energy policy is killing American jobs and America's future.  I will not vote for Barack Obama because he insists on shoving Obamacare down the throats of Americans even though well over fifty percent of the people want it either totally vetoed, or most of it vetoed.
Now, would I have voted for any African American candidate?  Absolutely.   I would vote for Herman Cain (I actually contributed to his campaign before he suspended it), I would vote for Allen West, I would have voted for Colin Powell, I would have voted for Condoleezza Rice.  But it has nothing to do with their ethnicity; it has everything to do with their experience, their political and economic philosophy, and their values regarding America's place in the world.
My problem with Liberals is that they are hypocrites, and it is very obvious that they do not like America as it functions now, and rather than take a pragmatic view of how to change it, they want to destroy it first, then remake it in their image.  Most of them are too young to remember America as I knew it growing up.    They cannot remember the America where the Federal Government lived within its restrictions of the Constitution, and left people alone to start and run their businesses.  They cannot remember the American where the trial lawyer lobby did not look for every opportunity to pass laws that created and grew the legal industry's pocketbooks to astronomical proportions.  They do not remember the days when the U.S. Supreme Court relied on Original Intent as they made decisions, rather than caving in and trying to socially engineer America to the prevailing philosophy of the day, whatever that might be.  They do not remember the time when America did not promote and create the "victim mentality" in order to restrict the rights of its citizens more and more.  No, they do not remember the great America of the '40s and '50s.  But I do.
Most of them do not have access or have not been exposed to the disastrous efforts of those societies in the past that tried to institute a utopian view of society.  Communism and socialism have been tried untold times, and in every instance, they have failed.  While beautiful in concept, there is no way to create that utopian society on this earth because of the basic sinful nature of man as a creature.  If we were all Christ-like individuals, then we would all be able to live in harmony with one another, we would all be in contact with the word and guidance that God has given us, and we would be able to share and share alike.
Unfortunately, the whole world is NOT Christ-like.  SATAN has deceived most of the world, and it is basically an evil place.  Mankind, by its very nature is greedy, self-centered, and materialistic.  And as long as there are evil people in the world, many of them running nations of the world, then America is going to have to have a government and an economy that will put us in a dominant position in this world, or we will be destroyed by those that will manipulate us out of existence as the world power  we are now.
We've already sent most of our manufacturing capabilities out of the nation.  We buy most of our material goods, clothing, electronics, cars, petroleum produce, and heavy building materials from other nations, when we have abundant capabilities and materials in this nation to do it.  We have operated our economy and our import and export business as a nation from a deficit position (buying more goods from overseas than we sell overseas) for decades.  In trying to "level" the economic status of everyone towards the middle class, we have given away so much money through entitlement programs (I HATE that term!), that we now have to borrow nearly fifty cents of every dollar our government spends.
We cannot sustain this way of operating as a nation and as a government without disastrous effects.  We are seeing that now in Europe with Greece, Italy, and other nations where they have taxed people to the point that they cannot tax them anymore, and they have exhausted their borrowing power, so they are defaulting on their debts, facing riots in the streets because they are having to take away all the freebies that they have given away in order to get elected.
America is looking straight at the disasters overseas, but the liberals in our government (and many of the conservatives also) do not have the political stomach to make the difficult decisions needed here to avoid that in our future.  Unless they do, because we are such a huge, diverse nation, we are facing far worse uprisings and economic disasters than Europe ever dreamed of.
Want to know why I would not vote for Barack Obama?  Want to why I would not vote for any liberal candidate right now?  Because I hear virtually all of them spouting rhetoric that reminds me of the socialist mantra that was spouted all over the USSR from about 1917 until it collapsed in 1989.
Is America's economy broke?  Yes, it is.  Can the government fix it?  Yes, it can, but not following the policies of Barack Obama and the liberals in government.  We need to turn the wagon around and go back towards a free, less regulated economy, and to cut government spending drastically so that we spend no more than we take in revenue to cover.
Government is there to protect our nation's people, possessions and territory, to facilitate interstate and international commerce, and to give people the opportunity to pursue their dreams and happiness.  It is NOT supposed to be their source of income if they cannot find a job in the private sector.  The Nanny State that we have become is certain NOT what the founding fathers intended, in fact it is exactly the opposite of what they intended.  It has evolved far too much in the opposite direction, and more resembles the super-powerful centralized Government that the Constitution was written to prevent!
So, America, it is time for all of us regardless of our ethnicity to take off the race-colored glasses and look realistically at the realities of this world.  We should NOT vote for Barack Obama, or Joe Biden, or Nancy Pelosi, or Harry Reid, or any other socialist/communist leaning liberal.  It is un-American to do so.  It goes against everything that the founding fathers intended.  Color should, and in most of the people who think like I do, does not, have any influence on whether I vote for somebody or not.  Ironic is it not that the same prejudice that the blacks hated and fought so hard to rid the nation of are now more prominent in their society than they are in white society today.  Too sad...

As you ponder what I write, more closely ponder those writings of probably the greatest American next to George Washington, our third President, Thomas Jefferson, of whom President John F. Kennedy said:  "I think this is the most extraordinary collection of talent, of human knowledge, that has ever been gathered at the White House - with the possible exception of when Thomas Jefferson dined alone."

" A wise and frugal Government, which shall restrain men from injuring one another, which shall leave them otherwise free to regulate their own pursuits of industry and improvement, and shall not take from the mouth of labor the bread it has earned. This is the sum of good government, and this is necessary to close the circlue  (circle) of our felicities.

"An association of men who will not quarrel with one another is a thing which has never yet existed, from the greatest confederacy of nations down to a town meeting or a vestry."

"Dependence begets subservience and venality, suffocates the germ of virtue, and prepares fit tools for the designs of ambition.
"I own that I am not a friend to a very energetic government. It is always oppressive."

"I predict future happiness for Americans if they can prevent the government from wasting the labors of the people under the pretense of taking care of them."

"Every government degenerates when trusted to the rulers of the people alone. The people themselves are its only safe depositories."

"Experience hath shewn, that even under the best forms of government those entrusted with power have, in time, and by slow operations, perverted it into tyranny."
